§1. General Provisions

These Terms of Service ("Terms") define the rules for using the Lunadate mobile
application ("Application") and the conditions for the provision of electronic
services by the Service Provider to Users.

These Terms constitute the terms of service referred to in Article 8 of the
Polish Act of 18 July 2002 on the Provision of Electronic Services.

The use of the Application requires reading and accepting these Terms upon the
first launch of the Application, as well as upon each amendment to the Terms —
to the extent required by law or functional changes. Acceptance of the Terms is
equivalent to entering into an agreement for the provision of electronic
services between the User and the Service Provider.

The Application is intended exclusively for persons aged 18 or over. Use of the
Application by persons under 18 years of age is prohibited.

The Application is a dating application designed for presenting profiles and
enabling contact between Users. The Service Provider does not guarantee any
match or the establishment of a relationship.

Astrological, numerological, and relationship test elements are informational
and entertainment-oriented in nature and do not constitute medical,
psychological, financial, or legal advice.

The Terms are made available in the Application in a manner that allows their
retrieval, reproduction, and storage.
§2. Definitions
Terms used in these Terms of Service shall have the following meanings:
- Application — the "Lunadate" mobile software
designed for devices running Android and iOS.
- User — a natural person aged 18 or over who
uses the Application.
- Account — the User's account in the
Application, enabling the use of Services.
- Services — electronic services provided by
the Service Provider through the Application, in particular: Account management,
profile presentation, matching, chat, relationship test, horoscope, safety
features, and subscription features.
- User Content — content shared by the User in
the Application (e.g., profile photos, bio, messages).
- Subscription — paid access to selected
features of the Application (e.g., Premium or Gold), provided as in-app
purchases in the App Store or Google Play.
- Stores — Apple App Store and Google Play
Store.
§3. Technical Requirements
Proper use of the Application requires:
- a mobile device (smartphone or tablet) with Internet access;
- Android version 7.0 (API 24) or higher, or iOS version 16.6 or higher;
- the Application downloaded and installed from the appropriate Store;

an active Internet connection (data transmission costs are borne by the User in
accordance with their agreement with the carrier);

for certain features — granting system permissions (e.g., access to photos;
location "while using the app"; notifications).
The Service Provider may temporarily restrict access to the Application due to
maintenance work, updates, or security incidents.
§4. Registration, Login, and Account

Account creation and use of the Application is done by logging in via: (a)
Google Sign-In or (b) Apple Sign-In.

The Application does not offer the option to create an Account using a login and
password in the "email + password" model.

The authentication and session management process is handled by Supabase Auth
(session tokens, session refresh).

The User agrees to use the Application solely on their own behalf. Impersonating
other persons or creating accounts that are misleading as to identity is
prohibited.

The User should protect access to their device and Apple/Google account. The
Service Provider shall not be liable for the consequences of third parties
gaining access to the Account due to the User's negligence.
§5. Scope and Nature of Services
Within the Application, the Service Provider provides in particular the following
Services:

creation and management of the User's profile (including photos, bio, interests,
preferences);

profile presentation and matching mechanism (swipe, match) and search filters;

compatibility indicators (including astrological) and relationship test results;
- chat between Users after a match is made;
- safety features: blocking and reporting other Users;
-
paid features under a Subscription (e.g., Soulmate mode, extended range, Gold
features — as described in the Application).
The detailed scope of features, limits, and availability of individual plans may
change as the Application evolves; the current feature description is available in
the Application and in the Stores at the time of purchase.
The Service Provider may release Application updates, including security and
functionality updates. Proper use of the Services may require installing updates.
If regulations require the provision of updates for a specified period, the
Service Provider will make them available in accordance with such regulations.
§6. Usage Rules and Prohibitions

The User is required to use the Application in accordance with the law, these
Terms, and principles of social conduct, respecting the rights of other Users
and the Service Provider.

Publishing or transmitting unlawful content is prohibited, in particular:
content inciting violence, pedophilic content, terrorist content, criminal
threats, content violating personal rights or third-party copyrights.

Harassment, stalking, hate speech, discrimination, blackmail, or other behavior
that compromises the safety or comfort of other Users is prohibited.

Using the Application for spam, phishing, fraud, extortion of data or money, as
well as for commercial activities without the Service Provider's consent is
prohibited.

Undertaking actions that compromise the security of the Application is
prohibited, including: attempts to bypass security measures, reverse
engineering, automation (bots), mass data extraction (scraping).

The User bears responsibility for User Content and the consequences of sharing
it, including for violations of third-party rights.

The Application, its name, interface elements, databases, and all materials
provided by the Service Provider (excluding User Content) are the property of
the Service Provider or its licensors and are protected by copyright and other
laws.

The User receives a non-exclusive, non-transferable license to use the
Application solely for personal use and solely for the purpose of using the
Services, for the duration of the agreement. In particular, copying, modifying,
distributing, decompiling, reverse engineering, or sharing the Application with
third parties is prohibited, unless mandatory law provides otherwise.
§7. User Content and License

The User represents that they hold the rights to their User Content (in
particular photos) and that sharing it in the Application does not infringe
third-party rights.

To the extent necessary for the provision of Services, the User grants the
Service Provider a non-exclusive, royalty-free license to use User Content in
the Application, including in particular: storage, display to other Users,
technical processing (e.g., compression), moderation, and ensuring security.

The license does not cover the use of User Content in advertising outside the
Application without separate, express consent of the User.

The User may delete their User Content or Account using the Application's
features; deletion may not affect content retained by other Users (e.g., copies
of messages) to the extent permitted by law and described in the Privacy Policy.
§8. Subscriptions and Payments

The Application may offer paid plans (e.g., Premium and Gold) providing access
to additional features. Subscription purchases are made in the Stores as in-app
purchases.

Payments, billing, cancellation, and Subscription management are governed by the
rules of the respective Store (Apple or Google). The Service Provider does not
process User payment card data.

Subscriptions may renew automatically. To avoid renewal, the User should cancel
the Subscription in their Apple/Google account settings in advance as required
by the respective Store (usually at least 24 hours before the end of the current
period).

The Service Provider may use a service provider to verify Subscription status
and entitlements in the Application (e.g., RevenueCat).

Payment refunds are processed in accordance with Store policies, subject to
mandatory consumer protection laws.
§9. Safety, Moderation, and Reports

The Service Provider provides safety mechanisms (including blocking and
reporting profiles and content) to protect Users and prevent abuse.

The User may report a profile, message, or other content that may violate the
law or these Terms, using the in-app feature or by contacting the Service
Provider at: support@lunadate.app.

The Service Provider may take moderation actions, in particular: restricting
content visibility, removing content, limiting features, suspending or deleting
Accounts — in a proportionate manner and in accordance with applicable
regulations.

In the case of significant actions taken against an Account (e.g., suspension or
deletion), the Service Provider may provide the User with a basic justification
and information about the possibility of filing an appeal, where required or
possible.

The Service Provider may counteract abuse of the reporting system (e.g., clearly
unfounded reports).

A User may appeal a moderation decision (e.g., content removal, feature
restriction, Account suspension or deletion) by sending a message to:
support@lunadate.app, within 30 days of receiving information about the decision
(if provided).

An appeal should include at minimum: (a) Account identification, (b) description
of the decision, (c) justification, (d) any supporting evidence. The Service
Provider will review the appeal within a reasonable time frame, informing the
User of the outcome where possible.
§10. Liability

The Service Provider exercises due diligence to ensure the Application functions
properly; however, it does not guarantee uninterrupted availability of Services
or the absence of errors.

The Service Provider shall not be liable for the actions of other Users,
including for User Content and the consequences of contacts and meetings outside
the Application.

Limitations of liability do not exclude or limit the Service Provider's
liability to the extent that such exclusion or limitation is not permitted under
mandatory provisions of law.
§11. Complaints and Support

Complaints regarding the operation of the Application or Services may be
submitted by the User to the email address: support@lunadate.app.

A complaint should include at minimum: a description of the problem, device
model, operating system version, Application version, and the complainant's
contact details.

The Service Provider shall respond within 14 days of receiving the complaint,
unless regulations require a different timeframe.

If you are a consumer, you are entitled to remedies in the event of
non-conformity of a digital service with the contract, under applicable
regulations (in particular, the right to have the service brought into
conformity, and in certain cases, a price reduction or termination of the
contract).

In relations with consumers, the provisions on digital services and remedies for
non-conformity with the contract shall apply.
§12. Termination of Use and Account Deletion

The User may delete their Account at any time in the Application settings (if
the feature is available) or by contacting the Service Provider for assistance.

If you have uninstalled the Application or do not have access to it, you may
submit a request for Account and data deletion by contacting the Service
Provider at: support@lunadate.app. To protect your data, we may ask for identity
verification.

Deleting your Account results in the loss of access to Services. Details
regarding data deletion are described in the Privacy Policy.

The Service Provider may suspend or delete an Account in the event of a
violation of these Terms or the law, in particular where the safety of other
Users is at risk.
§13. Personal Data

The rules for personal data processing are defined in the Lunadate Privacy
Policy, available in the Application.

Providing data is voluntary but necessary for using key features of the
Application (e.g., creating a profile, matching, chat).
§14. Amendments to the Terms

The Service Provider may amend these Terms for important reasons, in particular
in the event of: changes in legislation, changes in Application functionality,
the need to improve security, or to prevent abuse.

The User will be informed of any amendments to the Terms within the Application.
If the User does not accept the changes, they should stop using the Application
and delete their Account.
§15. Final Provisions

Matters not regulated by these Terms shall be governed by the provisions of
Polish law and European Union law applicable to consumer protection.

If any provision of these Terms is found to be invalid, the remaining provisions
shall remain in force.
-
Disputes arising from the use of the Application shall first be resolved
amicably; in the absence of an agreement — by the competent common court,
subject to consumer rights.
